The site-specific terms that govern your use of AuthorMailingLists.com.

1. Scope and acceptance
These site-specific Terms apply to your use of AuthorMailingLists.com (the "Service", "we", "us") and incorporate the Archieboy Master Terms by reference. By creating an account or using the Service, you agree to both these site-specific Terms and the Master Terms. Where a conflict exists, these site-specific Terms control for AuthorMailingLists.com.
2. What we offer
AuthorMailingLists.com is a backend mailing-list service for authors. Specifically, we provide:
- Subscriber list management with double-opt-in confirmation, an embeddable signup widget, and per-genre list segmentation.
- AI-assisted drafting of marketing emails grounded in a manuscript you upload (the "AI Drafter"). Drafts are suggestions; you review, edit, and authorise every send.
- Outbound email delivery via shared Amazon SES sending infrastructure, with automatic bounce, complaint, and engagement processing.
- Optional native importers for ConvertKit and other services, plus CSV upload.
- Subscription billing through Stripe.
3. Acceptable Use Policy
The Service runs on a shared sending pool. One account that abuses the pool damages deliverability for every other author on the platform. You agree to the following hard rules:
3.1 Permission-based sending
Every email address on every list must belong to a person who explicitly opted in to receive email from you, by name, on or near the topic of the list they joined. You may not send to:
- Purchased, rented, scraped, harvested, or appended email lists.
- Addresses obtained from a different newsletter, mailing list, customer base, or contact form unless those subscribers explicitly agreed to receive email from you specifically on this Service.
- Cold-outreach prospects, no matter how plausibly relevant.
- Any address that has unsubscribed, hard-bounced, or filed a spam complaint against you on this Service or any other service.
3.2 Re-confirmation policy
- Free tier: every imported address is re-confirmed by email before becoming mailable. There is no opt-out.
- Paid tiers: you may skip re-confirmation only if you (a) explicitly attest that every imported subscriber actively engaged (open or click) with you in the last 90 days and (b) your account is at least 30 days old. Submitting a false attestation is grounds for immediate suspension.
3.3 Import volume caps
To limit the blast radius of any single bad actor, every plan has both a rolling-7-day and a lifetime cap on imported addresses. The embeddable signup widget is uncapped — it is the permission-based growth path we want you to use. Current caps:
- Free: 100 lifetime imports total.
- Author: 1,000 per rolling 7 days; 10,000 lifetime.
- Active: 5,000 per rolling 7 days; 50,000 lifetime.
- Pro: 25,000 per rolling 7 days; 250,000 lifetime.
3.4 Bounce and complaint thresholds
The Service automatically monitors per-account performance over a rolling 7-day window. If your account exceeds either threshold below — and has at least 100 sends in the window — your account will be suspended automatically and all pending campaigns cancelled, pending human review:
- Hard bounce rate ≥ 2%
- Complaint (spam-flagging) rate ≥ 0.1%
These thresholds are tighter than Amazon SES's own published thresholds (roughly 5% bounces and 0.1% complaints sustained), so we suspend internally before AWS suspends us externally. We will email you when this happens. We will, in good faith, restore accounts where the underlying cause is technical or where you can demonstrate the list source meets §3.1.
3.5 Prohibited content
You may not use the Service to send: deceptive financial offers, fraudulent products, unauthorised pharmaceutical promotions, malware, phishing, sexually explicit content directed at minors, or anything illegal in your jurisdiction or the recipient's. Marketing your book is, of course, fine. Content that violates the AWS Acceptable Use Policy violates these Terms.
3.6 Compliance with anti-spam law
You are solely responsible for compliance with applicable anti-spam, privacy, and marketing laws in your jurisdiction and the jurisdictions of your recipients — including but not limited to CAN-SPAM (US), CASL (Canada), GDPR (EU/UK), and PECR (UK). The Service automatically attaches a one-click unsubscribe link and the RFC 8058 List-Unsubscribe header to every send; you may not remove, hide, or work around them. Your physical mailing address is included in the footer of every send (you provide it at signup); a fake or invalid address is a violation of CAN-SPAM and these Terms.
4. Account suspension and termination
We may suspend or terminate your account, immediately and without prior notice, if:
- You violate the Acceptable Use Policy in §3.
- You trip the bounce or complaint thresholds in §3.4.
- Your account is used for activity we reasonably believe is fraudulent (including stolen-card subscription payments).
- You attempt to bypass the import caps, the re-confirmation policy, or the rate limits — for example, by creating multiple accounts to multiply your effective caps.
If we terminate for cause under this section, no refund is owed for the unused portion of the current billing period. If you terminate your own account, you keep paid access through the end of the current billing period and then drop to the Free tier.
5. Subscription billing
Paid plans (Author, Active, Pro) are billed monthly or annually through Stripe. By subscribing, you authorise Stripe to charge the payment method you provide on a recurring basis until you cancel. Annual plans are billed once and are not pro-rated for early cancellation; monthly plans cancel at period end. Upgrades take effect immediately and are pro-rated; downgrades take effect at period end.
Refunds: we offer refunds at our sole discretion. We will, in good faith, refund the most recent billing period if (a) you cancel within 7 days of your first payment on a given plan or (b) you experienced a material service outage we caused. We do not refund payments made more than 30 days before the request.
6. Your content; AI-generated drafts
You own your manuscript and your subscriber list. We do not claim any rights in either. We process your manuscript only to generate the structured-themes JSON and the AI drafts you request, and only at the time you request them. We do not sell, share, or use your manuscript to train any AI model, our own or anyone else's.
AI drafts produced by the AI Drafter are provided to you for review and editing. Once you authorise a send, you take full responsibility for the content of every email that goes out under your name. We will not pre-approve or pre-vet AI drafts; the human review step is on you.
You grant us a limited, non-exclusive, royalty-free license to store and process your manuscripts, subscriber data, and email content solely for the purpose of operating the Service and complying with our legal obligations.
7. Subscriber data
Subscribers on your lists are your subscribers; they are not on our marketing list. We will not email them on our own behalf. If you delete your account, your subscriber data is deleted within 30 days, except where retention is required by law (e.g., suppression lists for compliance).
Subscribers always retain the right to unsubscribe from any of your lists, the right to be forgotten under applicable law, and the right to be added to our suppression list to prevent any sender on the Service from emailing them.
8. Service availability and limitation of liability
The Service is provided "as is" and "as available." We do not guarantee uninterrupted availability, error-free operation, specific deliverability rates to specific inboxes, or any particular open/click/conversion result. We use Amazon SES as our sending provider; outages or sending suspensions imposed by AWS are outside our control.
To the maximum extent permitted by law, our total liability arising out of or related to the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, exemplary, or punitive damages, or for lost profits or lost business opportunity.
9. Indemnification
You agree to indemnify and hold harmless Archieboy Holdings, LLC and its officers, employees, contractors, and agents from any claim or demand arising from (a) your violation of these Terms, (b) your violation of any third-party right (including intellectual property, privacy, or anti-spam laws), or (c) the content of any email you send through the Service.
10. Changes to these Terms
We may update these Terms when we add features, change policies, or respond to legal requirements. Material changes will be communicated by email to the address on file at least 14 days before they take effect, except where shorter notice is required by law or by an urgent security or compliance need. Your continued use of the Service after the effective date is acceptance of the updated Terms.
11. Governing law and contact
These Terms, and any dispute arising under them, are governed by and interpreted under the laws applicable to Archieboy Holdings, LLC as set out in the Master Terms. Notices and questions: hello@authormailinglists.com.
